Given tonight’s scandal, I’m going to pin this comment, but some background is necessary. Josh Blackman leans Right in some ways I disagree with, and one of those is the Roe ruling. However, he’s not doing so out of anti-abortion fervor (he’s Jewish, FWIW), but because he has a problem with some of the precedents that have derived from it. However much I think abortion should be left to those directly involved, he might be right, too.
If so, then it’s what I call a calf-pen problem. One of the nastier jobs on a farm is mucking out a calf pen, as their manure contains much less fiber than that of adults. This also means that half-measures, such as trying to shovel it all into one corner, won’t work, the pile will simply ooze downward. So the only thing you can do is accept that it’s going to stink, you’re going to get filthy, and then get in and do it anyway. Clean it up, and get it right, or things will just keep getting worse. He’s had a lot to say about this leak, and he hasn’t been forgiving to Chief Justice Roberts, either. That suggests to me that he grounded enough in his principles to not want his end to be achieved by cheating. I could go on, but better to read what a lawyer has to say. Better him than Politico, that’s for sure.
An addendum: Blackman rightly points out that the leaker’s done more harm than good, because now the SCOTUS’s ruling will come with the taint of social/political pressure, no matter what it happens to be. The would-be do-gooder has fucked the nation over, not saved it. And while it may not be Roberts’ fault, it’s damn sure his responsibility, so he’d better get to the bottom of it, in a prompt and transparent fashion. It’s his watch.
We can only hope that the institution can be salvaged now. Traditions and institutions are easy to destroy, but hard to replace with something better. Constants matter, and that applies to this series in particular. Monkey with them at everyone’s risk.
